Acceptance of Terms

By accessing or using the 3003 Official website (www.3003official.com) or purchasing any products, you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of our website, any orders for merchandise, and any digital content downloads (videos, photos) provided by 3003 Official. If you do not agree to these Terms, you must not use the Site or purchase our products. You are also subject to our Privacy Policy and any other policies posted on the Site.

3003 Official Pty Ltd is an Australian-registered company with operations in Spain. Our primary governing law jurisdictions are Queensland, Australia and Spain. By using the Site, you acknowledge and agree that these Terms will be governed by the laws of Queensland and of Spain, and any disputes may be resolved in courts located in Queensland (Australia) or in Spain, at the discretion of 3003 Official. Nothing in these Terms is intended to waive any consumer rights that you may have under applicable Australian or Spanish law.

Account Registration and Payment

You may create an account to purchase merchandise or subscribe for digital content. Account creation is managed through our Joomla platform. You must provide accurate and complete information during registration and keep your account credentials confidential. You are responsible for any activity that occurs under your account.

We offer two types of accounts:

• Free Account: No subscription fee. Grants limited access to digital downloads under a Creative Commons Attribution-NonCommercial (CC BY-NC) license for non-commercial personal use on social media.

• Pro Account: Monthly subscription (€15/month). Grants extended access to digital assets under the licenses described below.

All Pro account payments and merchandise purchases are processed securely via Stripe. By providing payment information, you agree to Stripe’s terms and our payment processing policies. You must be at least 18 years old to hold an account. We reserve the right to suspend or terminate any account at any time for any violation of these Terms, without notice.

Digital Content Licensing

Digital photos and videos (collectively, “Digital Content”) made available on this Site are licensed to you by 3003 Official under the following tiered licensing model:

• Free Account License: For Free account holders, Digital Content is licensed under the Creative Commons Attribution-NonCommercial (CC BY-NC) license. You may share and adapt the content for non-commercial purposes (for example, posting on personal social media profiles) provided you give appropriate credit to 3003 Official and the original creator. Free account use is limited to personal, non-commercial social media sharing only. Any other use (including use on websites, blogs, or in any commercial context) is strictly prohibited under the Free Account license.

• Pro Account License (Pro Creator content): For Pro account holders, Digital Content from Pro Creators (creators or brands with up to 1,000,000 subscribers) is also licensed under Creative Commons Attribution-NonCommercial (CC BY-NC), with extended permissions. You may use these assets on personal or organizational websites, blogs, online portfolios, crowdfunding pages, or in modest promotional materials (such as affiliate marketing or free giveaways), provided your use remains primarily non-commercial in nature. Attribution to the creator and to 3003 Official is required on every use on free accounts and encouraged on the Pro accounts.

• Mega Creator / Corporate Content: Any Digital Content from Mega Creators or Corporate Brands (creators or brands with over 1,000,000 subscribers) is not covered by the above CC BY-NC licenses. Use of Mega Creator or corporate-branded content requires a separate rights-managed license. If you wish to use such content, you must contact 3003 Official for a custom licensing agreement. Free or Pro subscriptions do not grant any license to Mega Creator content.

These licenses are royalty-free and worldwide. No fee or royalty beyond your account subscription grants you rights under this Agreement. All other rights in the content (including copyright and publicity rights) remain with the content creator or 3003 Official. By downloading or using any Digital Content, you agree to adhere to the above licensing terms and the separate License Agreement provided by 3003 Official (see below). Improper use of Digital Content (including unlicensed use, removal of credits, or use beyond the licensed scope) will constitute a breach of these Terms.

Use of Joomla and Stripe

Our website is built on the Joomla Content Management System, and account management is handled through Joomla’s user system. All payment processing is handled by Stripe. We do not store your full payment details on our servers. By making purchases or subscribing, you agree that Stripe collects and processes your payment information in accordance with Stripe’s Privacy Policy and security practices.

Intellectual Property

All content on the Site – including text, graphics, logos, images, videos, software, and other materials – is the intellectual property of 3003 Official or its licensors/creators. Except for the limited licenses expressly granted herein, 3003 Official retains all right, title, and interest in and to the Site content. You may not copy, reproduce, distribute, or create derivative works of any portion of the Site content without our express written permission, except as expressly permitted under the applicable license or applicable law.

Merchandise Purchases, Shipping, and Risk of Loss

When you purchase physical merchandise (“Merchandise”) on the Site, you agree to the following terms:

• Pricing and Payment: All prices are displayed in Euros (€) and do not include applicable taxes or duties, unless stated. You agree to pay the listed price plus any shipping and handling fees. Stripe will charge your payment method upon order placement.

• Shipping and Delivery: 3003 Official will arrange shipping of your order to the delivery address you provide. Estimated shipping times are provided for your convenience but are not guaranteed. Delivery dates may vary based on location, carrier, and customs processing. Risk of loss or damage to Merchandise passes to you upon our delivery of the items to the carrier or service provider. Title to the items transfers to you at that time.

• Taxes and Duties: If you order from outside Spain, you are responsible for any import duties, taxes, or customs fees imposed by your country. 3003 Official is not liable for these fees.

• Order Acceptance: All orders are subject to acceptance and product availability. We reserve the right to cancel or refuse orders for any reason, including inventory errors or fraud prevention, in which case we will notify you and issue a refund if payment has been taken.

Return and Refund Policy (Merchandise)

• Defective or Damaged Items: If you receive Merchandise that is defective or damaged, you must contact us within 14 days of delivery to request a replacement or refund. We may require proof of the defect (e.g., photos).

• Change of Mind: For change-of-mind returns of physical goods, you have a statutory right to cancel and return the items within 14 days (European Union) or 30 days (Australia), provided the items are unused, in original condition, and in resalable packaging. You must return the merchandise at your own cost. We will refund the purchase price (excluding original shipping) to the original payment method once the items are received and inspected.

• Exclusions: Personalized, made-to-order, or final sale items cannot be returned for change of mind. Digital downloads and licensing fees are non-refundable once the content has been accessed or delivered.

• Refund Method: Refunds will be issued to the original payment method within 14 days of our receipt of returned goods or our approval of a refund claim, as applicable.
  These return rights are subject to applicable Australian Consumer Law and European consumer regulations. Nothing in these Terms is intended to limit rights you may have under local law.

License Termination

Upon cancellation or termination of your account (Free or Pro), all licenses granted hereunder will terminate immediately. You must cease all creations of the Digital Content and delete any copies you made beyond those allowed by law. If your Pro subscription lapses, you may no longer download new content or claim any rights beyond what is covered in the Free Account license.

Disclaimers

To the fullest extent permitted by law, the Site and all products (including Digital Content and Merchandise) are provided on an “AS IS” and “AS AVAILABLE” basis. 3003 Official expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. 3003 Official does not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful code. We do not warrant or guarantee the results obtained from use of the Site or any content.

Any recommendations, opinions, or statements provided by 3003 Official or its representatives are for informational purposes only and do not constitute professional advice.

Limitation of Liability

In no event shall 3003 Official (including its officers, directors, employees, or affiliates) be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to these Terms, your use of the Site or products, or the Digital Content, even if advised of the possibility of such damages. Our total liability for any claim under these Terms or arising from use of the Site or products is limited to the total amount you have paid to 3003 Official in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless 3003 Official and its directors, officers, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to your use of the Site. This includes any claim arising from your breach of these Terms or your violation of any rights of another party.

Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland, Australia and the laws of Spain, without regard to conflict of law principles. You and 3003 Official agree to submit to the non-exclusive jurisdiction of the courts of Queensland (Brisbane) or Spain for any disputes relating to these Terms or our services. Nothing in this clause limits your rights as a consumer under applicable law.

Changes to Terms

3003 Official reserves the right to modify or replace these Terms at any time, at its sole discretion. We will post the updated Terms on our Site along with the date of revision. It is your responsibility to review these Terms periodically. Your continued use of the Site following the posting of changes will constitute your acceptance of the revised Terms.

3003 Official License Agreement

This License Agreement (the “Agreement”) is a legal contract between you (“Licensee”) and 3003 Official Pty Ltd (“Licensor”). By creating an account or downloading Digital Content from www.3003official.com, you agree to be bound by this Agreement in addition to the 3003 Official Terms and Conditions. If you do not agree to these terms, do not download or use our Digital Content.

License Grant

3003 Official grants you a non-exclusive, non-transferable, revocable license to use Digital Content subject to your account type:

• Free Account License: If you hold a Free Account, you are granted a Creative Commons Attribution-NonCommercial (CC BY-NC) license for the Digital Content. You may share and adapt the content for non-commercial purposes only (for example, personal or social media use). You must provide proper credit to 3003 Official and/or mention @3003official with every use. Commercial uses, including any form of advertising or sales, are not permitted under this license. The Free Account license covers social media sharing with appropriate credit and grants no rights beyond that scope.

• Pro Account License (Pro Creator Content): If you hold a Pro Account, you have an expanded CC BY-NC license for Digital Content created by Pro Creators (creators or brands with up to 1,000,000 subscribers). You may use Pro Creator Content on personal or organizational websites, blogs, online portfolios, crowdfunding pages, or in modest promotional materials (such as affiliate marketing or free giveaways), provided your use remains primarily non-commercial in nature. Attribution to 3003 Official and/or mention @3003official is encouraged.

• Mega Creator / Corporate Content: Content from Mega Creators or Corporate Brands (creators or brands with over 1,000,000 subscribers) is not included in Free or Pro licenses. Use of Mega Creator or corporate-branded content requires a separate, rights-managed license. If you wish to use such content, you must contact 3003 Official to negotiate a custom license agreement. Free or Pro subscriptions do not grant any license to Mega Creator content.

These licenses are royalty-free and worldwide. No fee or royalty beyond your account subscription grants you rights under this Agreement. All other rights in the content (including copyright and publicity rights) remain with the content creator or 3003 Official.

Attribution Requirements

Whenever you use licensed content, you must give credit as follows:

• Creator Credit: Include the name or handle of the original creator (as listed on 3003 Official).

• 3003 Official Credit: Acknowledge 3003 Official as the source (for example, “@3003official”).

• Visibility: Place credit in a clear, viewable location (for example, in the caption, description, or end credits). If used in video or audio content, include credit verbally or in writing.

• Link (if applicable): If possible, include a link to the original content or the 3003 Official site.

For example: “Photo by Jane Doe via 3003 Official.” Failure to provide adequate attribution is a breach of this Agreement and the license.

Restrictions on Use

Beyond the permitted uses above, you may not:

• Use the content in any advertising or paid promotion for a third-party product, service, or brand without an additional license.

• Incorporate the content into logos, trademarks, or product packaging.

• Sell, rent, or sublicense the content or any modified versions of the content as a standalone asset.

• Use the content in a manner that suggests endorsement by the creator or 3003 Official (especially in commercial contexts).

• Remove, obscure, or alter any copyright notice, logo, watermark, or attribution embedded in the content.

• Use the content in content that is pornographic, libelous, defamatory, illegal, or violates the rights of any person or entity.

• Share your account, distribute content to others, or otherwise allow any third party to use the content outside the scope of your account type.

Your use of the content must comply with all applicable laws and industry standards. Any unauthorized use of the content may result in termination of your license and potential legal action.

Termination

This license is effective as long as you maintain your account in good standing. We may immediately terminate this license (and/or suspend or terminate your account) if you breach any of its terms. Upon termination or expiration of your account or subscription, all rights granted to you under this Agreement will cease. You must stop using the Digital Content and delete or destroy any copies that are no longer covered by a valid license.

Termination of this license does not limit 3003 Official from pursuing any other remedies available under law.

Warranty Disclaimer

All Digital Content is provided “AS IS” without warranties of any kind. 3003 Official disclaims all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, or non-infringement. 3003 Official does not guarantee that the content is accurate, complete, or suitable for any specific purpose.

Limitation of Liability

To the maximum extent permitted by law, 3003 Official is not liable for any damages arising from your use of the licensed content. Our liability under this Agreement is limited to the extent set forth in our Terms and Conditions. We are not responsible for any violations of this Agreement by you or any third party.

Governing Law and Jurisdiction

This Agreement and your use of the Digital Content shall be governed by and construed in accordance with the laws of Queensland, Australia and the laws of Spain. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland (Brisbane) or Spain for any dispute arising under this Agreement. Nothing in this section limits your legal rights as a consumer under applicable law.

Miscellaneous

• This Agreement constitutes the entire license between you and 3003 Official for the use of Digital Content and supersedes any prior agreements or understandings.

• If any part of this Agreement is held unenforceable, the remainder will still apply.

• 3003 Official may update this License Agreement at any time by posting a revised version on the website. The date of last revision will be indicated. Your continued use of Digital Content after such updates will constitute acceptance of the modified terms.
